Federal Circuit Petition for Review
Judicial review of BIA decisions in the U.S. Courts of Appeals.
Overview
After the BIA dismisses an appeal, a Petition for Review (PFR) in the appropriate U.S. Court of Appeals is the next step. The PFR must be filed within 30 days β a jurisdictional deadline that cannot be extended. Federal courts review legal questions de novo but defer to BIA on facts.
